An itemized invoice showing $1,200 for the CPO would be ideal to show salesman's promise to CPO car. If the invoice is not itemized, I suspect the dealer can possibly deny if it choooses to. Do you have any witnesess who can testify as to promises made by your salesman?
If the dealer did in fact pocket the $1,200 and not registered car as CPO, then it seems that your cause of action may be against the dealer. Can't really see the manufacturer being liable in this case.
Again, I would contact dealer and sales to inquire about where they stand on this case. If they agree that car should have been CPO but failed to do so because of oversight or outright fraud or whatever reason, then your measure of damages could be refund of $1,200, registration as CPO if that is still possible or reimbursement of present repairs, although I would presume refund would be more straightforward.
