For interesting reading on the rest of the McDonld's story, see the linked web site. In summary, it says that McDonald's knew that the coffee was served too hot to drink (190*F), had received over 700 reports of burns caused by its coffee spilling, and didn't consider the safety risks of serving coffee at 190*F rather than 140*F as most other establishments do, and which woulnd't have caused 3rd degree burns to the old woman's genitals.
As for failing alternator bearings, if they failed at 5k miles you'd sure as heck want a new alternator, wouldn't you? A rattling speaker cover in a *new* car is either a design or manufacturing defect and, if represented by Saab that it won't rattle, should be repaired to your satisfaction.
Yeah, stuff happens all the time, and people need to take personal responsiblity for the things they do. But, if stuff happens to you because of what someone else did, you expect them to take responsibility, right? The legal system exists to make those who would otherwise refuse to take responsiblity do so. It is also subject to abuse by those who feel that everything that happens to them is someone else's fault. One of the many reasons I'm a corporate lawyer, not a litigator.
