Keeping with the McDonald's coffee thing...what was provided was *not* what was expected. What was expected was coffee which could be drunk, not coffee which was 30*F too hot to drink. The difference in temps made all the difference in the severity of the old lady's injuries. Oh, and she was held by the jury to be 20% responsible, presumably for spilling the coffee in the first place.
Oh, and people sue for the dumbest, most outrageous things -- winning is another story. I believe in the jury system and that 12 reasonable people will laugh stupid claims away. The problem is in defending such baseless suits - many companies just settle because it's cheaper and avoids public humiliation, no matter how wrong the case may be. One reason why I like the European system, where the loser pays both parties' legal fees -- it would immediately cut off about 90% of the sleazy personal injury bar (not implying that all personal injury lawyers are sleazy).
