Several scenarious are now possible given the coffee idea:

Had he been drinking coffee, he could have sued to coffee seller for failing to sell him coffee strong enough to prevent sleep.

Had the coffee been hot, he could have sued the coffee seller for his injuries sustained from burning coffee spilling on him as he flipped over.

And another wrinkle: if he made the coffee at home, then he could sue the coffee pot maker for making his coffee too hot.

How can anyone else besides the idiot himself be liable for his stupidity and irresponsibility? Has the state sued him for reckless endangerment for failure to recognize his sleep depraved status before engaging in the driving of 2 tons of steel? Cars meet Federal Safety Standards for this reason. Why is machinery held to a higher standard than the humanity that creates it? You are less of a human if you want to hold someone other than yourself responsible for your foolishness. Everyone makes mistakes, but only some people take responsibility for them.
