My understandng is that if the car is equiped with an "upshift' light, than the EPA fuel milage test will be run using the shift points as determined by the 'upshift' light. Otherwise, the shift points will be determined by the EPA procedure or the test driver.
So to maximize the EPA mileage on the required test, some manufactures (like SAAB) include 'upshift' lights on their vehicles. This is similar to the Honda Civic EX 'fuel efficiency model' a few years back that was fitted from the factory with 'special tires' basically ultra hard rubber, narrow profile, and high inflation pressure to improve mileage. Of course, most consumers switched to 'regular' tires when the factory tires wore out (or in the case of a friend, after they slid of the road in a thunderstorm) and just accepted the mileage penalty.
