Sparks from your engine is contained within your engine block hopefully and your fuel pump isn't spraying it everywhere :)
Smoking is another story. I would throw a bucket of water if some mofo is smoking while pumping.
Cell phone use is just as safe as the electronics in the pump itself.
When that guy in Jag asked "I need to?" you should just said "I'm asking you to" and if he didn't shut it off, you should have wrote down his license number and followed him home. Than you could mind your business after slashing his tires later.
I mean if he owned a private gas station and pumping his own gas by himself, than it's his business, but doing so in the public isn't his business for sure.
