In georgia the law is that if you refuse to do a test you loose your license.
That said, in my younger and stupider days I was pulled over. I refused. I was taken to jail. I refused the test again. I was asked a third time. Again I refused.
I was hit with a DUI charge.
My license was to be revoked after a hearing (this is like a normal traffic hearing).
The cop didn't show, so I got to keep my license until my criminal trial.
Since it would have been the cops word vs mine, and there was no sobriety test, no breathalizer, and no blood test, the DA reduced the charge to a reckless driving.
THAT said, I wouldn't want to go through it again. It cost me a small fortune (I estimate 10K+), it put a lot of stress in my life, and my insurance went up for a few years because of the reckless. Now I'm much more careful/smart.
If I had to do it all over again I would do the exact same thing. I will never take a breath test unless I know I'm going to beat it (1 beer maybe?). I think it's a perfect example of guilty until proven innocent.
I'd rather not have gone through that, but I'm sure I learned a lot because of it.
