Same thing happened to me in '06. I ended up getting about 3000 for a 14 year old 9000 where everything was in working condition. I had to deal with my own insurance company because the other guy had no insurance. I recall that these companies rely on independent companies who do an appraisal of the value of your car. They offered me about 1000. Ask for a copy of the report from the independent company. Mine showed that the value was based on a want ad from a city newspaper about 600 miles away. "'91 Saab $1500." They also called a guy at a Saab dealer who simply said that "I would only pay $1000 in trade for a '91." In response I went online and found every ad for a '91 9000 in the country. Not that hard since there are not that many. One car in my city had just sold for way more than the appraisal. I also threatened to hire an appraiser and go to arbitration. You might be able to sue but I was stuck with going to arbitration since it was my insurance. Hiring a lawyer is going to cost them a lot. Even arbitration could cost them a lot. They will have to at least pay for another independent appraisal just like you. Then if they loose they have to pay for arbitration. You could sue the uninsured driver in small claims court and show up with the documentation that you have for the value of the car and let the judge decide. The insurance company would have to pay what the judge said and hire a lawyer to show up. Don't give up. Find out how much you can collect in small claims court. The clerks there will help you.
