That's exactly why states are adopting statutes like in CA and here in CO requiring an exhaust to be EPA certified, it simplifies the task of law enforcement with respect to citing excessively noisy vehicles without having to have a decibel meter. Having lived in PA some yrs back and dealing with the state inspection I recall a muffler is required on vehicles, but the problem is with enforcement if the muffler is removed afterwards or doesn't comply with sound levels.
In CO I don't believe there is an grandfather provision, so if you have a pre epa certified exhaust of your motorcycle you can be ticketed, that could be the issue Scott is facing. As you point out with people using other than non stock exhaust systems for some it became a quest to have the loudest vehicle possible, another stellar example of inwardly focused thinking.
