First, good on you for the coal-rolling thing! I think there should be some reasonable leeway for people to modify cars to increase their performance. But deliberately increasing emissions (probably by a factor of 100) just because you can? That's just stupid and should not be tolerated.
On the EPA certification vs. Harleys thing, I have a funny feeling that won't work. I've never owned one, but as I understand it on those bikes there's an insert inside the exhaust pipe that does the muffling. People remove the insert to make the bike louder but the outer pipe with the "EPA" stamp on it remains intact. So just looking at the outside of the pipe, there's no way to tell the bike's been modified.
