I think it is a lot more information that needs to be disclosed for anyone to have an real opinion.
Your repair contract is first and foremost between your independent shop and you and what was spelled out in installing a used engine as far as guarantees and warranties.
Did he supply the engine or did you? If you supplied the engine the warranty is between you and the junk yard regarding the engine but if the indy got the engine it comes down to what he promised you or not.
Usually a common warranty is 3 month for used parts but it can be in any direction depending on the shop and/or what is discussed before the job starts.
I have a left over V6 engine here that never got installed and I could not go back to the junk yard claiming another one of it doesn't work out if I ever install it. I would have to make a personal mental decision if I want to take on that burden or not and for what price.
