I have a legal question of sorts. I was driving back to school in NY Monday afternoon 1:00-2:00 w/ my mom and my girlfriend.
While driving Thru Lawrenceville, PA into NY state, On the right of the rd. I saw 2 police officers had pulled over a car. I stopped at the red light, and he looked at me. The light turned green, I continued to drive, 100feet driving I crossed into NY, and started over the bridge and continued up the rd. I saw the first officer pulled out and followed, After he passed the NY line, he turned his lights on, As i was driving off the bridge i figured I'd pull over to let him by, So he proceeded to pull behind me. No clue why. I rolled my windows down, he came up, I said it there a problem officer? He said I'm actually stopping you for your tinted windows. conversation continued. He got the light meter. I asked aren't we IN NY and your a local pa cop. He's like actually it has to do with your plates. you have PA plates so i can cross the border and pull you over. (He wrote on the warning for loacton, Main st...and no state) He said If a car with tinted windows w/ NY plates drove into pa, I couldn't do anything. And boasted that He had pulled over "1000's" for tint violations. Mind you he looked very young. Because 5 Min's later another patrol car joined him, and i thought perhaps he was training or new.
Needless to say. He gave me a warning: All tint must be removed in 5 days, It then needs signed by any police officer and mailed back. (He said if you get it signed by a NY cop, don't ask what their laws are, just have them sign it, cause he didn't know, mind you i was in NY when he pulled me over.)
My questions to him, which he couldn't answer were:
I had the car since '01, and I purchased the car w/ tint on it. Isn't there laws that protect buyers of cars w/ preexisting tint? Pretty sure CA has one.
Then Is he out of jurisdiction. Since he passed into NY, and He didn't put his lights on until passing the welcome to NY sign?
And If I do have to remove tint, Don't I just have to remove just the front side windows, Not all 5. I heard back sides, and back windows were OK, Trucks and mini vans come from factory like that. What's the exception for cars, Seems like a gray area. Isn't wrong for one wrong for all? Law seems biased. And aren't some police cars tinted?
Also, What will happen to me if i don't remove tint at all.
It's gonna be a big hassle, a better part of the day, and will cost me $.
It is no financial gain to the officer.
My thoughts, when I bought the car - tint was already on the windows.
I would like to keep tint, because I view it as a safety advantage for several reasons.
Less glare from sun, better visibility - safer driving.
Also Without tint, the sun will destroy the leather - reasoning for previous owner installing tint.
Also Car came with very expensive stereo system, And if there was no tint, people could see right in and theft could be a greater risk.
So what are your thoughts, I now have 4 days to get this done, up here in Rochester it's snowy and miserable weather everyday, So there's no real easy and convenient way to do this.
I'd would just like to hear what you think my options can be.
