A couple other thots...

From Larry's post on Friday, he sounds like he has an auto trans, so it could run for awhile even though fluid had been drained. As the tech notes, not all the fluid comes out of the trans on that transmission.
But if it is a manual, it seems like it sure would have made a lot of noise (a whine or yowl) long before 6 weeks--like right away. Plus isn't the drain plug on the trans a socket head--like an allen head or similar? If so, seems like it would take a conscious effort to drain a trans.
Questions to ask in court:
In additon to asking wrench size and type...
How do they determine oil level in the engine? 4 qts over full would be very obvious on the dipstick.
How is the guy in the pit trained?
How long has he been doing the job?
What is his experience on Saabs?
And...
Is he color-vision impaired? This occurs as I write this, but someone with defective color vision could possibly mistake used oil (light to dark brown) and ATF (red or red-brown). This possibly worth checking into.
Or maybe he was just stoned.
Good luck.
