here is why.
When employee puts down the reference, there is a spot where you can say "prospective" employer can contact them or not. I guess if you put "no" than prospective employer can only do a background check and find out if it's true or not.
When they put "yes" than that mean anything goes. I think Urby has a right to tell them about her personality as well, but I think it's better for him to hold that back since he didn't know her on personal level.
Urby will only get in trouble if he lies about her work. If he says she never showed up and when she shows up, it's always late, then he could be sued or whatever, but as long as it's only truth, than he is justified.
I hope his H/R will agree. If she wanted her reference to come from H/R, than she would have put that down as her contact at this work and not Urby.
