Urby was stating that he was confused as to why he would be listed as a reference when the potential employee should have known that this was against company policy. This is a polite but indirect head's up to the hiring company that something is amiss. The hiring company can then ask the potential employee why an invalid reference was supplied - end of story.
Perhaps it would have been better to say "it has been against our company policy for the last X years to supply references, with the exception of HR".
If the potential employee wants to sue for giving a bad reference, I don't think it will hold water, as nothing bad was said about them, just that Urby was confused as to why his name was given.
If I was the hiring manager, I'd want a subtle head's up about a potentially problematic employee.
However, I hope for Urby's sake that this employee doesn't know that he's a frequenter of this BB.
