It's not so much a question of ethics as one of tort liability for you and your employer. Whenever I get a call like this about someone who did not perform satisfactorily, I just confirm the former employee's job title and dates of employment. Then when they ask me for any kind of further and subjective remarks, I say "I really can't comment on that." If the caller asks why not, I say "I really can't comment on that." By this point the caller has gotten the message without my having to say anything. After hanging up I make a written note of the call, date, time, who called, what was said. Problem solved.
