1) What is the MPH error on the radar gun (All of them are +/- 2 MPH at 50).
2) What is the MPH error of my speedometer (All of them are +/- 2 MPH)
3) Was the officers car calibrated for taking radar while at speed? If not, his measurements are invalid.
4) If yes, isn't that +/- 2MPH (yes)? Also, if not calibrated daily it is invalid).
5) Officer, to what accuracy have you been tested with visual speed testing ((Another +/- 1-2MPH)?
6) You mean you were driving, and looked at your speedometer and my car at the same time, through a curve and a rise in the road? How is that possible? Oh, so you looked at one, then the other whilest in a curve? That seems like a lot of things to do. In other words, you really don't know what speed I was doing as you visually paced me as when you looked at me, you couldn't be watching your speedometer.
7) If he wrote 74 on the summons your honor, he can't say now I was doing more. So which is it officer? Oh, so you admit to changing evidence to use in this court. That in and of itself shows this officer doesn't even document properly my speed and was not comfortable documenting it as evidence properly. Is that because he is not even sure how fast I was going?
8) Of course I hit my brake lights. I didn't want to hit the racoon in the road. I missed it but now you are penalzing me.
At the end, add up all the +/-'s, say you cannot be accurate to that degree of certainty, and hope the judge sees it.
