IMHO, the real shame in some of the telcom bubble and bust stories was the part where the workers who thought they had cushy retirement got left high and dry after the companies (or workers themselves) misallocated their pension funds into company stocks of the same companies. Unfortunate, but the employees should have been in a better position to know than average unrelated taxpayers.
Regarding IP, I thought in a normal bankruptcy situation, the IP would be picked up by someone else on the cheap just like the other assets of the failed company. If any patent is left on the table, it would effectively become public domain due to subsequent lack of defense action. That is a good thing for everyone else in the industry and consumers. The invention associated with the patent is already done, but nobody is left to collect rent on it. We could only wish to be so lucky. LOL.
The situation with GM restricting IP use by would-be buyer is SAAB is precisely a consequence of the government bailout of GM. If there had been no bailout of GM, the company would be in a much more urgent need for cash and would be willing to sell and license whatever IP there is to get money, instead of the current situation of bureaucrats dotting i's and crossing t's lest there be a remote chance of someone else making a huge success out of those IP's later and boomeranging back to get hurt their bureaucratic rear ends.
