Yes, I agree that two snows only can be bad, which is why I have always run four. Still, my first winter with FWD was in a '78 Scirocco. I only had snows up front and yeah, it could get a bit tail-happy but I never found it dramatic, and I don't remember it ever spinning out unless I was doing something dumb, usually going too fast and lifting off the gas in a corner. In hard braking all it ever did was get a little squirrely. No biggie. So maybe my experience is unusual.
OTOH, I've had a VW Beetle (the real one), understeer right into a snowbank with good snows on the back and decent regular tires up front. But I was probably driving too fast. ;o) Shoulda had snows up front, too!
My point is that if you rotate your tires they wear fairly evenly so there isn't a huge difference front to rear, AND replace them in sets of four, this issue simply doesn't arise. I still put the better tires up front, but the difference in tread depth isn't very great. So I guess that's a different argument.
Here in NH very few people run snows only on the front. And no one has them only on the back in FWD cars. But the tire stores all push 4 snows really hard.
As for the courts, I'm sure that's what every tire-seller is concerned with. But just because something is litigated a certain way doesn't make it right, IMHO.
