I'm not a lawyer - my background is physics + engineering, but...
In a legal system where one is innocent until proven guilty, one might expect to be able to easily contest a speeding ticket where the difference between the measured speed and the posted limit is less than the total measurement uncertainty: the measurement does not prove you exceeded the limit. Ie, what is the uncertainty in the measurement off the (specific) gun including the calibration uncertainty? One could further argue that a margin is required to accommodate the car's speedometer uncertainty, as it is very hard for the average driver to know what that is.
My understanding was that in general, 10% is added on for that reason (or more accurately, the ticket goes for 10% less than the gun reading). Maybe I'm just lucky, but so far, no tickets + I normally cruise at 75mph locally + have gone through numerous radar traps at that speed (even photo radar). I think a potential reason for this (in addition to luck) might be that the ticket for 10% over is not financially worth the effort, whereas every once in a while, somebody blitzes by at 40-50% over and gets a whopping fine... I figure if I'm below the 80th percentile, I'm not too likely to get pulled over... and that's typically 75-80mph around here...
maybe I'm wrong? I know I shouldn't be cocky, + maybe I have a bunch of tickets in my future, but it has worked so far...
