I'm not so sure that "reasonable man" includes kids that don't have fully developed judgement systems. "Most" states aren't ALL states, so I'm comforted to know that there are entire States that also agree with me. And there is a world of difference between handling small consumer-available firworks and a .22 rifle.
In any case I'm not trying to argue that Tito dosen't have "a case" for further action, but rather that because no real harm was done, that in my opinion, it would be better to exercise restraint instead-of trying to punish the parents and entire family for what their dumb kids did--potentially affecting a whole bunch of things for multiple people that shouldn't be compromised lightly or in an off-handed way.
And if we're talking-about being reasonable, the issue then becomes this as well: should a "reasonable man" in a gasoline powered vehicle drive directly over/beside/near anything that is clearly on fire?
