you have been "damaged" in some way if you go to court? Just because you can't load the car the way you want is probably not sufficient as the 9-5 is not the only car you could buy. And the fact that you aren't happy with the car in general is probably not enough to get GM to give you anything for your trouble. To show a systemic or design flaw you would need to quantify --in detail--the experiences of a significant number (whatever that may be) of other 9-5 owners who have the same problem. Maybe there is a design issue, but quantifying it to satisfy a court is another issue.

And isn't life too short to go through the hassle and expense of going to court? Maybe you have the free time to deal with this, but it seems like way to much work for too little return. You don't like your car, fine. So sell it and get something you do like. That's what most people do when they buy a product or service that doesn't meet expectations. Vote with your wallet.
