I did respond to ELaw's What? as to why the statute is applicable. It is not the $85 -- it is the percentage over what is the customary charge.
If this had been a gallon of milk, a percentage greater than 20% would have amounted to less than a dollar. It is not the actual amount, it is the percentage over the normal amount.
And as I responded to Simon S under "I was wrong," Chad is entitled to charge, more as a percentage, without putting himself inthe position of facing a defense of gouging.
